Kain Lawyers helps Cytomatrix secure significant IP licensing deal

Kain Lawyers has helped Melbourne stem cell therapeutics company, Cytomatrix Limited, on its development of a $100m US-based business to progress cancer treatments using umbilical cord blood stem cells. It was one of this year’s biggest research and IP licensing deals in Australia.

Corporate law specialists Gerry Cawson and James Burchnall developed a transaction structure that minimised regulatory hurdles and removed significant cost and time from the transaction. This was pivotal in Cytomatrix beating larger international rivals to the deal with the US-based Fred Hutchinson Cancer Research Centre.

“This was a complex international transaction and time was against us. It required an innovative solution which would work across international borders”, said Mr. Cawson, the team leader from Kain Lawyers.

“Our experience in working with public companies and in the health and medical sector gave us the skills and experience to make the most of this unique opportunity. We were particularly focused on an outcome that protected the Cytomatrix shareholders while maximising their commercial benefits.”
